Maharashtra Mandates Strict POSH Inspections: Is Your Business Ready? | SGC Services

COMPLIANCE ALERT: The Government of Maharashtra is cracking down on workplace safety. The Women and Child Development Department issued a critical circular on 14 May 2026. State authorities now have explicit authorization to conduct surprise, on-site inspections. They will verify strict compliance with the Prevention of Sexual Harassment (POSH) Act, 2013. Non-compliance triggers heavy legal penalties under Section 26.

The Women and Child Development Department, Government of Maharashtra has issued a new circular regarding stricter inspection of organizations under the POSH Act, 2013. Government authorities are now authorized to conduct POSH compliance inspections across establishments in Maharashtra.

Government authorities have now been authorized to conduct inspections of establishments to verify POSH compliance requirements.

As part of the inspection process, organizations may be required to demonstrate compliance related to:

  • POSH Policy availability and circulation among employees
  • Proper constitution of Internal Committee (IC)
  • Appointment of External Member
  • Display of POSH notices at workplace
  • Complaint handling mechanism and confidentiality process
  • Employee awareness and IC training sessions
  • Submission of Annual Report
  • Maintenance of inquiry records
  • SHe-Box portal compliance and updation

Important SHe-Box Requirements

Organizations should ensure:

  • Nodal Officer is appointed
  • IC details are updated on SHe-Box portal
  • Branch/location details are updated
  • Annual Report is uploaded on portal

Immediate Action Required

✔ Review POSH compliance status
✔ Verify IC constitution for all applicable locations
✔ Conduct awareness/training sessions
✔ Update pending SHe-Box details
✔ Keep all POSH documents and records inspection-ready
