The National Commission for Women (NCW) has shifted workplace compliance from a "box-ticking exercise" to an actively audited, legally enforceable mandate. In an advisory issued to all Chief Secretaries, Police Chiefs, and District Officers (including Gurugram), the NCW calls for the immediate enforcement of 18 comprehensive measures under the Sexual Harassment of Women at Workplace (PoSH) Act, 2013.
Ground-level enforcement is scaling up quickly. Establishments failing to comply face severe penalties, professional prejudice, and operational disruptions.
As per the advisory, all establishments are advised to review and ensure compliance with the statutory requirements under the PoSH Act as under:
- Internal Committee (IC) has been constituted in accordance with the PoSH Act, 2013.
- IC composition complies with the prescribed legal requirements.
- PoSH Policy, IC details, and complaint mechanism are displayed at the workplace.
- Regular awareness and sensitization programmes are conducted for employees, along with training for IC members.
- Annual Report and other statutory compliances under the PoSH Act are completed, wherever applicable.
- SHe-Box registration and related details are updated.
- All PoSH records and supporting documents are maintained and readily available for inspection or audit, if required.
At present, this communication is in the nature of a compliance advisory and does not require any immediate submission of documents. However, organizations are advised to review their existing PoSH framework and ensure complete compliance with the Act.
